New Private Copying Global Study shows potential for better remuneration of creators

CISAC, BIEM and Stichting de Thuiskopie study is a policy manual for governments on how to implement effective levy systems

 

November 23rd, 2020 - Private copying levies are a vital source of income for creators and rightsholders across the world. Yet they have an even greater potential if adequate legislation, proper application of the law and effective collection mechanisms are implemented. 

A unique study published today provides the most complete and authoritative analysis to date of private copying systems around the world. The new Private Copying Global Study 2020 has been produced by CISAC, in partnership with BIEM and Dutch Society Stichting de Thuiskopie. It provides an overview of private copying systems and the legal environment in 194 countries and five continents. The new study also describes the legal and enforcement measures needed to maximise the income they raise for creators and rights holders. It also illustrates the potential economic benefits if levies are effectively implemented to cover digital devices.

In 2018, global collections of private copying levies for all rights holders totalled EUR 1,046 million. This includes EUR 367 million for authors, representing 3.8% of global authors’ collections.

Commenting on the new study, CISAC Director-General Gadi Oron says: “Private copying levies are an important source of income for rightsholders, with tremendous potential for growth. Our challenges it to promote the legal, enforcement and operational environment that would support further growth in this area. The new report offers invaluable insight and important guidance to decision makers for unlocking the economic potential of private copying levies, to the benefit of local creative communities”.

Today’s publication is the result of a good cooperation between three complementary organisations in the defence, the diffusion and the acknowledgement of private copying around the world. We hope this report will help in developing further the scope of private copying, in terms of territories and equipment concerned, at the benefit of the creators, by raising awareness of the authorities”

Hester Wijminga, Director of Stichting de Thuiskopie, says: “In 1991 Thuiskopie started compiling information on the existing private copying systems in the world in order to learn and share best practises in collecting and distributing private copying remunerations on behalf of rightsholders. Now, so many years later, we are very pleased that in partnership with CISAC and BIEM we are able to present a global report on private copying. Sharing our knowledge and combining our expertise have resulted in the most extensive and complete work on private copying yet to be published.”

The 2020 Global Study combines and extends two previous reports, by Stichting de Thuiskopie (International Survey on Private Copying – Law and Practice 2016, in collaboration with WIPO), and by CISAC (the 2017 Global Private Copying Study). BIEM is also partnering in the new project to promote better awareness of the importance of private copying.

Numerous governments have focused on actions to improve private copying collections in recent years. In the Africa region, four new countries have recently started collecting private copy remuneration (Malawi, Morocco, Tunisia, and Cap Verde).

Currently the West African Economic and Monetary Union, supported by CISAC, is supporting the adoption of a Directive aimed at implementing private copying levies in 8 member states (Benin, Burkina Faso, Ivory Coast, Guinea Bissau, Mali, Niger, Senegal, and Togo). Positive developments are also taking place in Latin America and Asia.

The study – a summary

The common study is intended as an information tool for governments and policy makers, a reference for negotiations on fees and a source of data. It contains all the information that stakeholders need to know on private copying, from the legal framework to the practical implementation of private copying.

Using multiple data sources, the study examines the copyright laws of 194 countries in 5 continents and classifies, for each continent, the countries under 4 categories, from the lowest level of development to the most developed:

• Countries without a private copying exception.
• Countries with a private copying exception but without a remuneration system.
• Countries with a remuneration system but without collection and distribution mechanisms.
• Countries with remuneration system and collection and distribution mechanisms.

New elements include:

  • Broader analysis: the new study covers both authors’ rights and neighbouring rights (for example, the figures of collections include both authors’ and neighbouring rights shares). Countries hitherto not included were also added.
  • More data: detailed information on tariffs/levy and devices (media/equipment) subject to the levy, as well as private copying collections from 2015 to 2018
  • More contextual analysis: the study outlines the model private copying system, from the legal background to its practical implementation:

  3. Exemptions
  4. Collection process and distribution schemes
  5. Social and cultural deductions.
  • New economic analysis: the study includes a comprehensive economic analysis of private copying revenue trends in the last 4 years, with levy income estimates based on levies paid by 2 hypothetical households in different territories

  • The economic analysis also includes an estimation of revenue potential per device for 7 targeted countries with potential future regulatory amendments (Bulgaria, Canada, Denmark, Japan, Korea, Mexico, Nigeria)

  • European Case Law: the study contains an annex with the relevant European Court of Justice decisions on private copying.

Pour quelles finalités les données sont-elles collectées ?

1. Selon les cas, MAC2 traite vos données en tout ou partie pour les principales finalités suivantes :

• la gestion et le suivi de la création de compte et de la relation avec les clients de manière générale ;
• la gestion et le suivi des commandes, paiements, livraisons, expéditions et retours, ainsi que du service clientèle / service après-vente ;
• la gestion des comptes clients ;
• la gestion commerciale et marketing ;
• la mesure de la qualité et de la satisfaction ;
• la prospection commerciale et la personnalisation des offres.

2. MAC2 vous informe que certaines données doivent obligatoirement être fournies pour passer une commande sur le site.

Quelle est la base juridique du traitement ?

1. Selon les cas, MAC2 traite vos données en tout ou partie sur les bases juridiques suivantes :

• Soit vous avez consenti au traitement de vos données personnelles ;
• Soit ce traitement est nécessaire à l’exécution d’un contrat auquel vous êtes partie ou à l’exécution de mesures précontractuelles prises à votre demande ;
• Soit ce traitement est nécessaire aux fins des intérêts légitimes poursuivis par MAC2 ou par un tiers (par exemple, le magasin vendeur).

A qui sont-elles transmises ?

1. Les données traitées sont destinées selon les cas aux personnes suivantes :

• notre service client ;
• nos éventuels sous-traitants et partenaires contractuels et commerciaux ;

2. Par ailleurs, les données pourront être communiquées à toute autorité légalement habilitée à en connaître en particulier en cas de réquisition judiciaire des autorités judiciaires, policières ou administratives.

3. Afin d´assurer la sécurité des paiements, MAC2 utilise les services d’un prestataire, FIA-NET. Lorsque vous passez une commande et réglez le paiement par carte bancaire à MAC2, notre système de prise de commande se connecte en temps réel avec le système de FIA-NET qui collecte vos données et procède aux diverses vérifications pour éviter les abus et les fraudes.

Combien de temps les données sont-elles conservées ?

1. MAC2 conserve vos données pendant une durée fixée selon des critères permettant de couvrir la durée nécessaire à la réalisation de la finalité augmentée, le cas échéant, des délais de prescription et/ou des durées de conservation obligatoires.

2. Les données utilisées à des fins de prospection seront conservées pendant 3 ans à compter du dernier contact entrant pour les prospects et 3 ans à compter de la dernière commande pour les clients.

Quels sont vos droits ?

1. Conformément à la règlementation relative à la protection des données personnelles, vous disposez d’un droit d’accès, d’interrogation, de rectification, d’effacement (droit à l’oubli) et de limitation du traitement des données vous concernant.

2. • lorsque cela est possible, la durée de conservation des données à caractère personnel envisagée ou, lorsque ce n’est pas possible, les critères utilisés pour déterminer cette durée;
• l’existence du droit de demander à la MAC2 la rectification ou l’effacement de données à caractère personnel, ou une limitation du traitement des données à caractère personnel relatives à la personne concernée, ou du droit de s’opposer à ce traitement;
• le droit d’introduire une réclamation auprès d’une autorité de contrôle;
• lorsque les données à caractère personnel ne sont pas collectées auprès de la personne concernée, toute information disponible quant à leur source;
• l’existence d’une prise de décision automatisée, y compris un profilage,
• et, au moins en pareils cas, des informations utiles concernant la logique sous-jacente, ainsi que l’importance et les conséquences prévues de ce traitement pour la personne concernée.

3. Lorsque les données à caractère personnel sont transférées vers un pays tiers ou à une organisation internationale, vous avez le droit d’être informée des garanties appropriées, en ce qui concerne ce transfert.

4. Vous avez le droit d’obtenir deMAC2 , dans les meilleurs délais, la rectification des données à caractère personnel vous concernant qui sont inexactes. Compte tenu des finalités du traitement, vous avez le droit d’obtenir que les données à caractère personnel incomplètes soient complétées, y compris en fournissant une déclaration complémentaire.

5. Vous avez le droit d’obtenir de MAC2 l’effacement, dans les meilleurs délais, de vos données à caractère personnel et MAC2 a l’obligation d’effacer ces données à caractère personnel dans les meilleurs délais, lorsque l’un des motifs suivants s’applique:

• les données à caractère personnel ne sont plus nécessaires au regard des finalités pour lesquelles elles ont été collectées ou traitées d’une autre manière ;
• vous retirez votre consentement sur lequel est fondé le traitement, et il n’existe pas d’autre fondement juridique au traitement ;
• vous vous opposez au traitement, et il n’existe pas de motif légitime impérieux pour le traitement ;
• les données à caractère personnel ont fait l’objet d’un traitement illicite ;
• les données à caractère personnel doivent être effacées pour respecter une obligation légale qui est prévue par le droit de l’Union ou par le droit de l’État membre auquel MAC2 est soumise.

6. Vous disposez aussi du droit à la limitation du traitement de vos données personnelles lorsque l’un des éléments suivants s’applique :
• vous contestez l’exactitude de vos données à caractère personnel, pendant une durée permettant à la MAC2 de vérifier l’exactitude des données à caractère personnel;
• le traitement est illicite et vous vous opposez à leur effacement et exigez à la place la limitation de leur utilisation;
• MAC2 n’a plus besoin des données à caractère personnel aux fins du traitement mais celles-ci sont encore nécessaires pour vous pour la constatation, l’exercice ou la défense de droits en justice;
• vous vous êtes opposé pour des raisons tenant à votre situation particulière, à un traitement de vos données nécessaire à l’exécution d’une mission d’intérêt public ou relevant de l’exercice de l’autorité publique dont est investie MAC2 ou nécessaire aux fins des intérêts légitimes poursuivis par MAC2 ou par un tiers y compris le profilage fondé sur ces dispositions pendant la vérification portant sur le point de savoir si les motifs légitimes poursuivis par MAC2 prévalent sur ceux de la personne concernée.

7. Vous disposez aussi du droit de vous opposer à tout moment, pour des raisons tenant à votre situation particulière, à un traitement des données à caractère personnel nécessaire aux fins des intérêts légitimes poursuivis par MAC2 ou par un tiers y compris le profilage fondé sur ces dispositions.

8. Vous avez le droit de ne pas faire l’objet d’une décision fondée exclusivement sur un traitement automatisé, y compris le profilage, produisant des effets juridiques vous concernant ou vous affectant de manière significative de façon similaire sauf lorsque la décision :
• est nécessaire à la conclusion ou à l’exécution d’un contrat entre vous et MAC2;
• est autorisée par le droit de l’Union ou le droit de l’État membre auquel MAC2 est soumis et qui prévoit également des mesures appropriées pour la sauvegarde de vos droits et libertés et de vos intérêts légitimes ;

10. MAC2 vous informe également que vous disposez du droit d’introduire une réclamation auprès d’une autorité de contrôle.

11. Dans un souci de confidentialité et de protection des données personnelles, MAC2 doit s’assurer de l’identité de l‘utilisateur avant de répondre à sa demande. Aussi, toute demande tendant à l’exercice de ces droits devra être accompagnée d’une copie d’un titre d’identité signé.

About BIEM

BIEM (Bureau International des Sociétés gérant le droit d'enregistrement et de reproduction mécanique) is the international organisation representing mechanical rights societies. Mechanical rights societies exist in most countries. They license the reproduction of songs (including musical, literary and dramatic works). Their members are composers, authors and publishers and they are contracting with record companies and other users of recorded music. They also license mechanical aspects of the exploitation of music via the Internet.

The mechanical rights societies issue the licenses and collect the royalties which they distribute to the owners of each work.

BIEM represents 60 societies, from 57 countries.

Members of BIEM enter into representation agreements to allow each of them to represent the others' repertoire. In this way, a BIEM society is able to license users for the vast majority of protected works in the world.

BIEM negotiates a standard agreement with representatives of the International Federation of the Phonographic Industry (IFPI) fixing the conditions for the use of the repertoire of the societies. The standard agreement is applied by the member societies to the extent that there is no compulsory licence or statutory licence in their territory. BIEM's role is also to assist in technical collaboration between its member societies and to help in solving problems that arise between individual members.

BIEM represents and defends the interests of its member societies, particularly in forums relating to authors' rights. BIEM also collaborates with the international non-governmental organisations, which pursue the same objectives as its own. These include, in particular, CISAC (International Confederation of Societies of Authors and Composers) and GESAC (European Grouping of Societies of Authors and Composers).

Collection and use of Personal Data

Browsing

Data we collect. You may access and read material on this website without giving us any information that directly identifies you. BIEM's further use of your account data. BIEM members directory

Public information. BIEM keeps a directory of its members and of their representatives to serve the legitimate interest of BIEM and its members to inform the public about membership. The public part of the website identifies members of the Official Bodies by their name and first name.

Communication among BIEM and its members. BIEM keeps a private directory of its members, and of their representatives (i) to serve the legitimate interest of BIEM and its members, (ii) to manage our relationship with our members, and (iii) facilitate communication among members.

Data. The internal directory inventories the identity and professional contact information of the representatives, their role and/or participation to BIEM committees and other activities, and, also, to the discretion of the member's representative, emergency and other useful contact information (including PA contact information). Use. If you register for an account and you represent a BIEM member, your directory information (identification, position, BIEM member, professional contact details) may be used to update the BIEM staff contacts. Confidentiality. The 'Staff Contact details' are only accessible to BIEM employees, and registered BIEM members' representatives.

BIEM databases

BIEM proposes databases on licensing conditions, BIEM's members collections figures, Societies' contact staff and signatories of the BIEM/IFPI Contract and a Manufacturing agreement. It serves the objectives of BIEM and helps our members to license, collect and distribute royalty payment for protected works of their respective affiliates.

Registration data. When accessing BIEM databases, your personal data (identification, credentials, connexion data) may be processed by BIEM, (jointly with appointed administrators) where applicable, for the purpose of granting you access to the BIEM databases. –Retention. Your personal information is kept by BIEM and where applicable the administrator of the BIEM database, as long as your registration is active.

Joint controllers. –If you are a registered user, BIEM, and if applicable jointly with the BIEM database administrator, acts as data controller regarding the processing of your personal data. The BIEM member you are represented or in contract with, is responsible for the registration, the update and the deletion of your personal data into the BIEM website.

BIEM event management

Our legitimate interest. BIEM organize events with its members and third parties to offer forum of discussion and serve the legitimate interest of BIEM and its members to communicate about their activities.

BIEM members data. –Use. When participating to a BIEM event, your personal data (identification and contact information, record of your participation, food and other preferences) may be processed by BIEM for the purposes of planning the event (date, localisation, food, attendance), and provide information to individuals about this event. –Retention. Information about your food and other preferences will be deleted right after the happening of the event. Additional information is used to organise future events but also to understand your needs and interests in our events. Information about attendees which represent BIEM members will also be used to up-date BIEM records, such as CISAC directory, which is accessible to BIEM members,. This information will be kept by CISAC, on behalf of BIEM, as long as you are a BIEM member.

Other attendees' data. When participating to a BIEM event as an attendee or presenter, your personal data (identification and contact information, record of your participation and food preferences) may be processed by CISAC for the purposes of planning the event. Information about your food preference will be deleted right after the happening of the event. Other information will be kept in order to keep a record of the participation, organize future events and provide information to individuals about events and future events.

Data controller. BIEM acts as data controller. However, where the event organised jointly with BIEM members or third parties, BIEM and such third parties generally act as joint controllers. To find out, please consult specific information notices linked to the event.

General requests. You may request information, have a question and want to make a suggestion to us and there are a number of ways to get in touch with BIEM. You may contact us by post, by phone, or by completing the email form in our website or communicate with us in any other way.

Technical support. When you contact us for any technical or other website related support, we may retain that information on record so as to process your request. Such information may include the transcript, emails or other information which is relayed by you throughout the support request process.

Data we collect. In order to process your request, we may collect information to identify and contact you (at least your name and your email address), about the nature and the content of your message.

Legal basis. By communicating with us in any way, you consent to the processing of your personal data by BIEM and disclosure to the third party for the purposes of managing your inquiries and answer your questions. When you contact us as a Member representative, your data is processed based on our legitimate interest to offer assistance to our members.

Retention. General support requests data is deleted after a period of one year once we have processed your request for evidence purposes. Technical support data is deleted once we have processed your request.

Data controller. BIEM is the data controller of data processing activities necessary to deal with your requests.

 

Other Data processing

We only use and disclose personal data for the purposes which directly relate to one of our missions or activities. We will not provide your personal information to other entities or bodies unless the following applies:

Processors

BIEM shares your personal data collected with CISAC who acts as data processor acting on behalf of BIEM for all personal data processing necessary to manage BIEM's activities, including the management of and the services proposed through this Site. We may also share your personal information with trusted third parties that perform business functions (e.g. hosting of our website), or provide services (e.g. management of events) or with the administrators of BIEM databases, to provide you with access to the databases.

 

International transfers
