In 2023, a BIEM/CISAC working group was formed to study the use of protected works by Text and Data Mining processes for training data intelligence systems. This study resulted in the publication of guidelines that specifically look at the assignments of rights to societies and the changes needed to allow societies to opt out and reserve rights in relation to TDM exceptions [BIEM23-0297].

In the next step, BIEM is monitoring the application of reservation of rights in the context of TDM by its community through a survey launched in January 2024. The document mapping the situation in BIEM territories contains three charts:

  1. Tab 1, lists societies having enforced a reservation clause and the text of the clause on the society homepage and/or its translation in English;
  2. Tab 2, the societies intending to enforce the reservation clause;
  3. Tab 3, countries where the law does not allow the enforcement of the reservation right.

The situation is still evolving with new enforcement of the reservation clause or new laws being adopted.

Keep us posted on new developments, the document is reviewed as updates are received : see the latest version 4.6 (April 2026) & its Enclosure
